6TEN9 LLC provides business software solutions, consulting services, and digital platforms designed to integrate with enterprise resource planning (ERP) systems, including Microsoft Dynamics 365 Business Central. The specific features and availability of services may vary by subscription tier or agreement.

User Accounts

To access certain services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify 6TEN9 immediately at system@6ten9.com of any unauthorized use of your account.

Acceptable Use

You agree to use the services only for lawful purposes and in a manner consistent with all applicable laws and regulations. You may not:

• Use the services to transmit any unlawful, harmful, or fraudulent content.
• Attempt to gain unauthorized access to any portion of the services or related systems.
• Interfere with or disrupt the integrity or performance of the services.
• Reproduce, duplicate, copy, sell, or resell any portion of the services without express written permission.
• Use automated tools to scrape, crawl, or otherwise extract data from the services.

Fees and Payment

Certain services are provided on a subscription basis. Fees are billed in advance and are non-refundable except as expressly stated herein. 6TEN9 reserves the right to modify pricing with reasonable prior notice. Failure to pay applicable fees may result in suspension or termination of services.

Intellectual Property

6TEN9 and its licensors retain all intellectual property rights in and to the services, including all software, content, and materials. Nothing in these Terms grants you any right, title, or interest in the services or any 6TEN9 intellectual property other than the limited license to use the services in accordance with these Terms.

Confidentiality

Each party agrees to maintain the confidentiality of the other party's proprietary and confidential information and to use it only for purposes consistent with these Terms. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

Data and Privacy

Your use of the services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the services, you consent to the collection and use of your information as described in the Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law, 6TEN9 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of or inability to use the services, even if 6TEN9 has been advised of the possibility of such damages.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 6TEN9 DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Termination

6TEN9 reserves the right to suspend or terminate your access to the services at any time, with or without cause, and with or without notice. Upon termination, all licenses granted herein will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Houston, Texas.

Changes to Terms

6TEN9 reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the date at the top of this document and, where appropriate, notifying you by email. Your continued use of the services after any changes constitutes your acceptance of the new Terms.
